Privacy Notice

This privacy notice (the "Notice") is established in accordance with the Federal Law for the Protection of Data in Possesion of Private Companies or Individuals (“Ley Federal de Protección de Datos Personales en Posesión de Particulares”), its Regulations and the Privacy Notice Guidelines.

 

  • Identity and address of the Responsible

    Pactare Vínculos que Generan Bienestar, S.A.P.I. de C.V. ("Pactare" or "we" or "us"), is responsible for the processing of your personal data.

        We collect and use the following data:

        • Identification data: name, nationality, date of birth, marital status, personal image.
        • Contact information: address, e-mail, telephone.
        • Official data: Taxpayer ID, tax domicile, Single Population Registry Code (“CURP”), IMSS affiliation number and data contained in birth certificates and official identifications such as voter's credentials, passport or visa, including signatures.
        • Professional data: title, professional license, descriptions of educational and professional trajectory.
        • Financial data: bank account information.
        • Emergency contact information: name, relationship and telephone number of the designated person.

        We use this data to:

        • Make necessary communications.
        • Prepare contracts and documentation.
        • Integration of files.
        • Make salary and benefit payments and tax withholdings.
        • Contact people in case of emergency.
        • Registration in insurance and benefits.
        • Attendance and access control.
        • Assignment of work tools.

        • Identification and contact information: name, address, e-mail, telephone.
        • Official data: Taxpayer ID and data included in your tax status certificate and compliance opinion, including tax domicile, as well as data contained in official identification such as voter's credential, passport or visa, including personal image and signature.
        • Financial data: bank accounts and other information provided to us by customers for review, analysis and the provision of our services.

        Employees and representatives (officers, service providers or consultants) of our customers:

        • Contact and identification data: name, address, e-mail, telephone and position and data contained in official identification such as voter's credential, passport or visa, including personal image and signature.

        We use this information to:

        • Identify and contact our customers and their employees or representatives.
        • To provide our services.
        • Issue invoices and process payments.
        • Prepare proposals for additional services.
        • To establish, maintain and comply with the legal relationship existing between the parties.
      • Potential customers

        We collected:

        • Identification and contact information: name, address, e-mail and telephone number.
        • Data of your employees or representatives (officers, service providers or consultants): name, address, e-mail, telephone and position.

        We use this information to:

        • Contacting and communicating with potential customers.
        • Prepare proposals for requested services.
      • Candidates for employees or service providers

        We collected:

        • Identification and contact information: name, nationality, date of birth, address, e-mail, personal image.
        • Professional data: educational and professional trajectory and data contained in the degree and professional license.
        • Work or professional references: name, position, telephone number and e-mail address of the persons designated for references.

        We use this information for the purpose of contacting the third party and evaluating the possibility of establishing an employment or service relationship with the candidate.

      • Participants in research or benefit delivery programs

        We collected:

        • Identification and contact information: name, e-mail and telephone number.

        We use this information in order to have a record of beneficiaries or participants and thus avoid the delivery of duplicate benefits.

    • SECONDARY PURPOSES

      We use your name, job title, phone number and e-mail address to send you:

      • Information about Pactare events.
      • News related to Pactare.
      • Information on relevant topics related to the object, services or activities of the clients.
    • DISTINCTION BETWEEN PURPOSES
      • The purposes described in paragraph 1 are necessary to establish and maintain the relationship with you.
      • The purposes described in paragraph 2 are not necessary for our relationship.
    • OTHER PURPOSES AND SENSITIVE DATA

      If we need to use your information for a different purpose, we will let you know in advance.
      Pactare does not process sensitive personal data. If we need them, we will ask for your express written authorization.

  • Refusal to Process Personal Data

    If you do not want us to use your data for the secondary purposes mentioned in Section II.2, you have 5 days from the date you received this Notice to let us know by email, including:

    • Your full name.
    • Documents proving your identity.
    • Specific indication that you do not want the use of your data for secondary purposes.
    • Your address for notifications.

    Even if you do not exercise this right within the time period indicated, you may do so at a later date through the procedures for revocation of consent or objection.

  • Transfers of Personal Data

    Pactare will share your personal data with third parties only as necessary to establish, maintain or fulfill the relationship we have with you.
    If we need to share your data for other reasons, we will ask for your prior authorization, except in the cases allowed by Article 37 of the Law.
    When we share your data, we inform the recipient about this Notice and the permitted purposes of use. The recipient must comply with the same obligations as we do.

  • Personal Data Referrals

    In order to provide our services to you, Pactare works with suppliers who support us in various activities. These suppliers act on our behalf and follow our instructions. They are obliged to:

    • Use the data only for authorized purposes.
    • Refrain from using the data for your own purposes.
    • Comply with this Privacy Notice.

    Our suppliers may be located in Mexico or in other countries.
    From time to time, we act as agents for our customers and therefore process personal data provided to us by those customers on their behalf and in accordance with their instructions.

  • ARCO Rights

    You may exercise your rights of access, rectification, cancellation or opposition ("ARCO Rights") through a request that includes:

    • Your name and address or means of communicating your response.
    • Documents proving your identity.
    • Clear description of the personal data and the right you wish to exercise.
    • Any information that makes it easier to locate your data.

    For rectification requests, you must also indicate which modifications are desired and provide supporting documentation.
    We will respond within 20 days and, if applicable, we will implement the changes within 15 days. These deadlines can be extended once for the same period if necessary.

  • Revocation of Consent

    You may revoke your authorization for the use of your data by following the procedure in Section VI.
    Revocation:

    • It has no retroactive effect.
    • It does not apply when the data is required by a legal or contractual obligation.
  • Limitation on Use or Disclosure

    To protect your data:

    • Our staff signs confidentiality agreements.
    • We use password security systems.
    • We limit access to your data.

    To stop receiving promotional communications, you can:

    • Use the mechanisms in each communication.
    • Submit an application following the procedure in Section VI.
  • Use of Tracking Technologies

    When you visit our website, we automatically collect:

    • IP Address
    • Operating system
    • Browser type
    • Access location
    • Pages visited

    This information helps us to improve your experience and generate statistics. You can disable these technologies in your browser settings.

  • Changes to the Privacy Notice
